Stimfluencer Programme Terms

Version 2.0 · 30 October 2026 · These terms govern your place in the Stimz Stimfluencer programme.

Welcome to the Stimfluencer programme. These terms are the agreement between you and us. They cover how we count your sales, what you earn, when we pay it, and the rules you have to follow when you post about us. Please read them before you accept. If you do not accept them, you cannot take part.

1. Who we are

The programme is run by Flexi Fidgets Co. Ltd, a company registered in England and Wales under company number 15982398, whose registered office is at 43 Dollywaggon Way, Bamber Bridge, Preston PR5 6EW, trading as Stimz. In these terms "we", "us" and "our" mean that company, and "you" and "your" mean the person accepting these terms.

You can reach us at stimfluencer@stimz.com.

2. Joining the programme

2.1 The account holder is an adult, and that is who we contract with

Every Stimfluencer account is held by someone aged 18 or over. That person is who this agreement is with, who we pay, and who is responsible for everything done under the account. By accepting these terms you confirm you are 18 or over.

If the person making the content is under 18, the account is held by their parent or guardian, in that adult's own name. The adult accepts these terms, controls the account and receives any commission or rewards. This applies at every age under 18: a 16 or 17 year old can be the person who makes the content, with their parent or guardian holding the account.

This is the structure we have chosen for this programme, and we apply it to everyone. It is not a statement about what someone under 18 can do in general. It keeps one adult responsible for the account, the payments, the labelling rules and any tax, and it matches how our payment provider works, which requires a parent or guardian to own a payout account where the person is under 18.

By accepting these terms, where someone under 18 appears in your content, you also confirm that you hold parental responsibility for them. If we find that an account is really held by someone under 18, or by an adult without parental responsibility for a child appearing in the content, we will close it and stop any payment.

2.2 Whether your child appears is a decision for you and your child

Whether your child appears is a decision for you and your child, appropriate to their age and understanding. Stimz never requires a child to appear. Your child must be happy to take part each time and must always be free to stop.

Some of our Stimfluencers are parents whose children use our products. You can take part fully without your child ever appearing: you can make content yourself, and you can simply tell us how things went.

  • Nothing depends on it. No commission rate, level, credit, gifting, selection or opportunity in this programme is ever conditional on a child appearing. A parent who never shows their child is at no disadvantage.
  • We do not direct children. For ordinary participation in this programme we will not give you a filming brief for your child, or tell you what your child should say or do.
  • Every time, not once. If your child does not want to take part on a given day, or wants to stop partway through, that is the end of it.
  • You are responsible for their welfare while making it, and for everything in these terms about the content itself — the labelling in section 9 above all, which applies in exactly the same way.

There may be a licence or permit to get, and checking is your responsibility. In the UK, local councils license children taking part in performances and in paid modelling, and issue permits for some kinds of work by children. Whether anything is needed in your circumstances depends on what the content is, how old your child is and where you live, and the rules are not always obvious from reading them. If you are not sure, contact your local council before you post. It costs nothing to ask. If we ask you to confirm you have whatever is needed, tell us the truth.

Every post you add in your portal asks whether anyone under 18 appears in it. If someone does, we ask how old the youngest is and for three confirmations: that you have parental responsibility, that the child was happy to take part and knew they could stop, and that you have checked whether a licence or permit is needed and have one if it is. We then ask, separately, whether we may repost that post. Saying no is a free choice that changes nothing else, and you can change your answer on any post at any time. We record each answer and when you gave it. We ask because it changes what we will do with the content, and because we would rather know than find out.

No content featuring a child will be used in paid advertising without a separate agreement with you and our own checks first. Section 15.1 already rules out paid advertising without separate agreement for everyone; where a child is in the content we are more careful still.

We may decline to accept, use or repost content involving a child if we have any safeguarding or licensing concern, and we may ask you to take a piece of content down or pause your account while we look at it. We would rather have that conversation than not.

Campaigns involving a child sit outside this programme. If we ever wanted a child to appear in something specific — giving them a role, a script or a deliverable, or rewarding their appearance — that would not be part of ordinary Stimfluencer participation. It would be considered separately before anything went ahead, and it would never be offered through the programme itself.

2.3 Your details

Tell us the truth when you sign up, and keep your details current. That includes your name, your email address, your social media handles and your payment details. If any of them change, update them in your Stimfluencer portal. We will use the details you give us to attribute your sales and pay you, so wrong details usually mean wrong or missing money.

2.4 One account each

You may hold one Stimfluencer account. If you run more than one, we may close all of them and withhold anything unpaid.

2.5 We decide who joins

We can accept or refuse any application, and we do not have to give a reason. Being refused does not mean you have done anything wrong.

2.6 People who work for us

Our employees and directors, and members of their immediate households, cannot earn commission through the programme.

3. Your status

You are self-employed and independent. You are not our employee, our worker, our agent or our partner, and nothing in these terms makes you any of those things. Specifically:

  • You never have to post. There is no quota, no schedule and no minimum sales. If you go quiet, genuine sales that still come through your existing links and codes keep earning; see section 5.6 for how inactivity can affect other things.
  • You decide what you make and when you post it. We may give you brand guidelines and we do require the legal labelling in sections 9 to 11, but we do not direct your creative work and we do not approve your posts before they go out.
  • You can have someone else make your content. If the person in your content is your child, everything in these terms is an agreement with you, not with them, and whether they take part is a decision for you and them. See section 2.2.
  • You are free to promote other brands, including ones that compete with us. We do not ask for exclusivity. If a future paid campaign ever needed it, that would be agreed, and paid for, in its own separate agreement.
  • You use your own equipment and cover your own costs. We do not reimburse expenses unless we have agreed to in writing beforehand.
  • You do not get holiday pay, sick pay, notice, a pension or any other employment benefit from us.

If we ever agree a paid campaign with you, with a brief and deliverables, that will be a separate written agreement on its own terms. It will not change the nature of this one.

4. How we track your sales

We would rather explain this properly than have you find out from a dispute. Here is exactly how a sale gets counted as yours.

4.1 The four ways an order can be attributed to you

When an order comes in, we check these in order and use the first one that matches:

  1. One of your follower codes. The order used a discount code you created (see section 6). This both attributes the order and sets the rate for it.
  2. Your personal discount code. The order used your standing code.
  3. Your link. Someone clicks your personal link, we store your code in their browser and place it on their basket, and it travels through to the order.
  4. Your own email address. If the customer's email is the same as yours, we record the order against you but mark it as your own purchase and it earns nothing. See 12.1.

A code beats a link. Typing a code at checkout is the customer choosing who they bought through, so if an order uses your code it is yours, whatever links they clicked beforehand. A link only decides an order that used no Stimfluencer code.

4.2 What this means in practice, including where it fails

  • Your code is more reliable than your link. A code works on any device, in any browser, however long after they first saw your post, and it survives a customer clearing their browsing data. Lead with your code.
  • Links have a window of up to 30 days from the click. On Apple devices and in Safari this is usually much shorter, around 7 days, because of how those browsers handle stored data. That is a limit of the browser, not a choice of ours, and we cannot extend it.
  • Links do not follow someone between devices. If they click on their phone and buy on a laptop, only a code will carry the sale to you.
  • Among links, the most recent click wins. If someone clicks another Stimfluencer's link after yours and then buys without using a code, the sale goes to them. If they use your code, it is yours.
  • Express checkout buttons skip your link. The quick-pay buttons on a product page (such as Shop Pay, Apple Pay and Google Pay) go straight to checkout without the basket, so your link cannot reach those orders. Your code still works there, which is one more reason to lead with it.
  • If a customer blocks or clears cookies and browser storage, or refuses tracking, we cannot attribute a link click and no commission arises.

Our records of clicks, codes and orders are what we use to work out attribution and commission. If you think something has gone wrong, tell us within 60 days of the order and we will look into it properly and show you what we hold. We are not able to reconstruct attribution from evidence outside our own system.

5. What you earn

5.1 Your revenue share

You earn a percentage of the revenue on orders attributed to you. Your current percentage is shown in your portal.

5.2 What the percentage is applied to

We apply it to the value of the products in the order, after every discount has come off, excluding VAT and excluding delivery. Nothing else in the order counts.

Prices on the shop are shown with VAT already in them, so VAT has to come out before your share is worked out. We do that line by line, using the VAT actually charged on each product in that order, not an average across the basket.

That matters because a lot of what we sell goes out under VAT relief for disabled people, under Group 12 of Schedule 8 to the Value Added Tax Act 1994. Where a customer claims it, no VAT is due on that product, so nothing is taken off for VAT and the whole amount they paid for it counts towards your share. A standard rated product in the same basket has its 20% removed as usual. You are never worse off because of which products someone chose, or because they were entitled to relief.

One thing worth saying plainly, because it looks confusing on a receipt: our shop applies VAT relief by taking the VAT off at checkout, so it appears on the order as a reduction of about 16.67%. That reduction is not treated as a discount against your share. It is the VAT coming off, and we only ever take the VAT off once.

Delivery never counts, whether the customer paid for it or we gave it away.

A worked example. Someone buys two things using your link:

LineThey payVATCounts towards your share
Standard rated product£24.00£4.00£20.00
Product on VAT relief£30.00£0.00£30.00
Delivery£3.99—£0.00
Total£57.99£4.00£50.00

At an example share of 10%, you would earn £5.00 on that order. (The 10% is only for illustration. Your actual share is the one shown in your portal.)

Now the same basket during a 10% sale of ours, which takes £5.40 off the standard rated product. The discount comes off first, so the VAT falls to £3.10 and the amount that counts is £54.00 − £5.40 − £3.10 = £45.50. At the same example share, you would earn £4.55.

Discounts include your own follower code, your personal code, and any sale or promotion we happen to be running that the customer also used. Where a discount stacks with ours, your share is calculated on the smaller amount that results.

Every order in your portal shows this breakdown, so you can check any of it: what the products came to, what came off as discount, what came off as VAT, what delivery was, and the figure your share was actually calculated on. VAT relief appears under VAT, as explained above, so an order on relief looks the same as any other and a customer's entitlement is never shown to you.

5.3 Levels

Everyone starts on the standard rate. We may operate levels that move your percentage up automatically as your figures grow, using measures such as revenue, orders, followers, posts and views. You sit on the best level whose minimums you meet. If your figures fall, you move back down. The current levels and their minimums are shown in your portal.

Measures can count over a recent period rather than all time, such as the last 30 or 90 days. Where they do, a level depends on staying active: if you have not posted in that period and your level asks for a post, you move down. The period for each measure is shown in your portal next to what your level asks for. Moving down only ever affects orders placed afterwards (see 5.4).

We can also set a rate for you by hand, and where we have, it overrides the levels. Level movement is automatic, but a person here can review and change any rate. If you think your level is wrong, ask us and a person will look at it.

5.4 Your rate is fixed at the moment of each order

The percentage that applies to an order is the one in force when that order is placed, and it is stored against that order. Moving up a level later does not increase what you earn on past orders. Moving down does not reduce it either. Your history is never rewritten.

5.5 We can change rates and levels, for any reason

We may change the standard rate, any rate we have set for you personally, the levels, and what each level asks for, including its measures, minimums and periods. We may also add or remove levels. We can do this at any time and for any reason, and we do not have to give one.

We will email you at least 14 days before a change takes effect. Changes only ever apply to orders placed after they take effect, so what you have already earned is never reduced (see 5.4). If you would rather not carry on under the new figures, you can leave under 18.1.

5.6 Your earlier content keeps earning

If you stop posting, genuine orders that still come to us through your existing links and codes continue to count and continue to earn, on the normal rules, for as long as your place in the programme continues. Going quiet does not cancel commission on real sales your earlier content produced.

Over time, inactivity may affect other things: your level, gifting, perks, or your place in the programme. If we ever end a place for inactivity, we will do it under section 18.2, and you keep everything you have properly earned.

5.7 The leaderboard

We keep a leaderboard of Stimfluencers, scored on sales through your link and codes, the views on the posts you add to your portal, and the likes and comments on them. Customer reviews play no part in it. It is there so we can spot and recognise great work. It is not published, and other Stimfluencers do not see where you are on it.

  • We can only count what each network shows us. Instagram does not share view counts for photo and carousel posts, so those count on their likes and comments. Facebook does not share any figures with us, so a Facebook post adds nothing unless we enter its figures ourselves. A post on a private account, or one that has been removed, cannot be read at all. Sales through your link and codes always count, whatever you post.
  • We read a post's figures for a limited time after it goes up, at the moment for its first two weeks, as your portal says. After that its figures stay as they were last read.
  • Each post counts once. We take the tracking off the end of the link you paste, and a post that has already been added, by you or by anyone else, cannot be added again.
  • Leaderboard points are a ranking, not money. They do not change your share by themselves, and they cannot be exchanged for cash.
  • There are no set prizes. We may pick people doing great things, usually those near the top, for things like testing products, early access to new releases, being featured, store credit, or a promotional bonus rate. What is on offer, to whom and for how long is our decision, and we will tell you when something is. A promotional rate runs for the period we tell you when we offer it, and ends on its own at the end of that period; that end is not a change to your rate under 5.5.
  • As section 2.2 says, nothing on the leaderboard, and no reward for it, ever depends on a child appearing in your content.

6. Your follower codes

You can create a discount code that gives your followers a percentage off, funded out of your own revenue share. You choose how much to give away, and your share is reduced by that amount on the orders that use the code. You can set a usage limit and an expiry.

Orders that do not use the code are unaffected. Someone buying through your link, or with your standing personal code, still earns your normal share while your follower code is running. The reduced rate applies to that code and nothing else, and once the code runs out or expires it stops applying at all.

  • Codes are percentage-off only. We do not offer fixed-amount codes, because a £10 code on a £12 order costs more than the order is worth.
  • Your codes work alongside our own promotions. Revenue is calculated after all of it.
  • You can use your codes on your own orders too, but follower codes are made for your audience. See 12.1 on big discounts used for you, your family or your friends.
  • Your code is for your own audience. Do not post it to coupon sites, deal forums, voucher aggregators, browser extensions or anywhere else designed to harvest codes. If a code of yours leaks to one of those places we may end the code, and we may withhold commission on orders that came through it.
  • We can end any code at any time if it is being misused, if it is costing more than it earns, or if it breaches these terms.

7. When we pay you

7.1 Orders clear after 28 days

Commission on an order becomes payable 28 days after the order is placed. Until then it shows in your portal as "still clearing" and it cannot be paid out.

That wait covers picking, dispatch, delivery, and the period in which a customer can change their mind, return the goods or cancel. It exists so that we are not paying commission on sales that are about to come back. It is not a delay in paying you what you are owed; it is the point at which you become owed it.

We may change this period on 14 days' notice. Any change applies to orders placed after it takes effect.

7.2 Getting paid

  • Payments are made through Stripe. You will need to complete Stripe's own sign-up, which includes identity checks that Stripe carries out, not us. We never see your bank details.
  • Until your Stripe account is set up and verified we cannot pay you. Your earnings still accrue in the meantime.
  • Payments are in pounds sterling. If your bank account is in another currency, your bank or Stripe may convert it and charge for doing so. Those costs are yours.
  • We pay monthly. Each month we pay out everything that has cleared by then. Anything still inside its 28 day window waits for the following month.
  • There is a minimum payment, shown in your portal. If your cleared balance is under your threshold when a payment run happens, nothing is sent and the balance rolls into the next month. It is not lost, it just waits.
  • You can raise your own threshold if you would rather have fewer, larger payments. Your portal lists the amounts you can choose from. You cannot set it below the minimum.
  • Stripe's fee for sending your payment comes off it. We pass it on at cost and add nothing to it: at the moment £2 for each month in which you receive a payment, plus 0.25% and 10p per payment, so £2.22 on a £50 payment. Your portal shows the fee before you are paid, and your statement shows your commission, the fee and what reached you. Swapping for store credit under 7.4 has no fee.

7.3 VAT

All rates and amounts are stated excluding VAT. Our own VAT number is 494303485. If you are VAT registered, tell us and give us your VAT number, and we will pay the commission plus VAT at the applicable rate. If you are not VAT registered, no VAT is payable and the commission is the whole amount. Tell us within 14 days if you register for VAT, deregister, or your number changes. If we pay the wrong amount because you did not tell us, you will need to put it right.

7.4 Taking your balance as store credit instead

Instead of waiting for a payment, you can swap some or all of your cleared balance for store credit to spend on stimz.com. When you do, we add a bonus on top. Your portal shows the bonus and the exact amount of credit before you confirm. At 20%, for example, £10 of commission becomes £12 of credit.

  • Only cleared commission can be swapped, but any amount of it, and with no fee. The payment minimum and the payout fee in 7.2 do not apply. If we ever set a smallest swap, your portal shows it.
  • The credit goes onto the stimz.com customer account that uses the same email address as your Stimfluencer account. If you do not have one yet, create it on stimz.com first.
  • A swap is final. Store credit cannot be turned back into a payment, exchanged for cash or passed to someone else. We do not set an expiry date on it, and it stays yours if your place in the programme ends.
  • The commission you swap comes off your balance as if we had paid it to you. If an order behind it is later refunded or cancelled, section 8 applies in the same way as a refund after payment.
  • Orders you pay for with the credit are your own purchases, so they earn no commission (see 12.1).
  • We may change the bonus or the smallest swap, or stop offering swaps, at any time and for any reason. A change never affects credit already added.
  • Swaps are not available to VAT-registered Stimfluencers, who are paid in money under 7.3.

8. Refunds and cancellations

Commission is earned on sales that stick.

  • If an order attributed to you is refunded in part, your commission is recalculated on what the customer kept.
  • If an order is refunded in full or cancelled, no commission is due on it.
  • The same applies to chargebacks and to any order we find was fraudulent.
  • Refunds of delivery charges do not affect your commission, because delivery was never part of it.

Where an order changes after we have already paid you, we will set the difference off against your next payment. If there is no further payment to set it against, the amount is repayable to us on request. We will always show you which orders an adjustment relates to.

Adjustments come to us automatically from our shop, so they are applied whether or not the order had already cleared. We also check recent orders against our shop every night, so a refund or cancellation still counts even if the shop's message about it never reached us.

9. Labelling your posts

A post about us that is connected to this programme is an advert in law, and it must say so, clearly, at the start. Section 9.3 sets out exactly when a post counts. While you are in the programme with a live link or code, that is nearly every post you make about us. This is the rule we enforce most strictly, because when you get it wrong the regulator names both of us.

9.1 What you must do

  • Put "Ad", "Advert" or "Advertisement" at the very beginning of the caption, with or without a hash.
  • On video, also show it on screen, early, legibly, and for long enough to read. Saying it out loud as well is better still.
  • It must be visible before anyone has to tap "more", scroll, or click through.
  • It must be readable on a phone. Not tiny, not low contrast, not lost in a block of hashtags.

9.2 What does not count

None of these are enough on their own, and using them instead of "Ad" is a breach of these terms:

  • A discount code by itself. Most people do not read a code as an advert, and the regulator has ruled on exactly this.
  • "Gifted", "Sponsored", "Supported by", "Thanks to @stimz", "#collab", "#brandambassador".
  • "#aff", "#affiliate", "#sp", "#spon", or anything spaced or starred to dodge detection.
  • "Commission earned" or "I may earn a commission". You can add wording like this if you want to, but it goes alongside "Ad", never instead of it.
  • A disclosure at the bottom of the post, or in the comments, or in your bio.

9.3 The rule applies even when the post has no link in it

Label any post about us where any of these is true, whether or not that particular post carries your link or code:

  • you are posting it as part of this programme, or in response to anything we have asked for or suggested;
  • you received the product, or anything else, through this programme;
  • you could benefit from it, because your link or a code of yours is live and someone might reach us through you.

In practice, while you are in this programme and have a live link, that is nearly every post you make about us. If you are weighing up whether a particular one counts, label it. Nobody has ever been in trouble for labelling something that turned out not to need it.

This does not reach back over your whole life. A post you made about us before you joined, and an unprompted mention with nothing attached to it once you have left, are not adverts because you are on this list.

9.4 We check, and we act

We monitor content that mentions us. If we see something unlabelled or wrongly labelled we will ask you to fix it, and you must do so promptly. We are required to do this and we are not able to let it slide. Repeatedly failing to label your posts will end your place in the programme, and we may withhold commission on the posts concerned.

10. What you must never claim

Never say or suggest that our products treat, help, manage, relieve or improve ADHD, autism, anxiety, stress, depression, sensory processing disorder, or any other medical or psychological condition. Not in a caption, not on screen, not out loud, not in a comment, not in a reply to a follower.

We know this feels counter-intuitive for products used by neurodivergent people, so here is the reason. What is claimed for a product is part of what decides how it is regulated, and a claim that something treats or relieves a condition can put it in a category we are not registered to sell in. Health claims of that kind also have to be substantiated to advertise them, and ours are not, because our products are sensory tools rather than treatments. Because you are promoting us, what you say lands on us as well as on you.

None of that is a comment on your own experience. If a Stimz product genuinely helps you, say so in your own words, about you. What you cannot do is turn that into a claim about what the product does to a condition.

10.1 Please do not say things like

  • "This helps my ADHD" / "great for ADHD" / "an ADHD must-have"
  • "Calms my anxiety" / "stops my panic attacks" / "anxiety relief"
  • "Therapy for autistic kids" / "stops meltdowns" / "regulates my son"
  • "Better than medication" / "you won't need [any treatment]"
  • Anything that names a condition and attaches an effect to it, however casually.

10.2 Please do say things like

  • "I love the texture on this one"
  • "Keeps my hands busy while I'm on calls"
  • "Really satisfying to click"
  • "This is the one I keep in my bag"
  • "Popular with the neurodivergent community" (describing who likes it, not what it does)

Talk about how a product feels, what you do with it and why you like it. Do not talk about what it does to a condition.

10.3 Other claims

Do not overstate what a product does, invent facts about it, misdescribe the price or what is included, or present a paid placement as an independent review.

10.4 Your content is not a customer review, and we never buy reviews

We will never offer you anything for leaving a review, and you should refuse if anyone ever does. Not commission, not credit, not product, not entry into a draw.

There is a real difference between the two things and it matters more than it sounds:

  • Your content is promotional. You may have had product, you may earn from it, and it carries "Ad" so everyone can see that.
  • A customer review on our shop is supposed to be somebody's ordinary, unpaid opinion. Since April 2025 it has been against UK consumer law to publish reviews that are fake, or that are incentivised without saying so.

So: you are welcome to review our products as a customer, and we would like you to. But if you were sent the product, or you are in this programme and could earn from it, say so in the review itself. And we will not pay you, credit you or reward you for writing one, whatever it says.

Feedback you give us privately — in a testing round, by email, in a form — is a different thing again. It is for us, it is not published as a review, and we would much rather have it honest than flattering.

11. Children and vulnerable audiences

Many of our customers are children, and many are neurodivergent. That places extra obligations on both of us.

  • Never tell children to buy, and never tell them to ask an adult to buy. "Ask your mum to get you one" and anything like it is specifically prohibited by UK law. This is not a grey area.
  • Do not exploit a young audience's inexperience or trust, or suggest that anyone will be left out, unpopular or lesser without our products.
  • Do not exaggerate what an ordinary child could do with a product.
  • If a meaningful part of your audience is under 16, be extra careful with your "Ad" label: make it larger, put it right next to the content, and say it out loud in video. Younger viewers are far less able to spot advertising.
  • If your audience skews under 16, talk to us before your first post and we will go through it with you.

12. Things you must not do

12.1 Buying through your own link or code

You are very welcome to buy our products. You just do not earn commission on your own purchases. Orders placed using your own email address are automatically flagged and excluded. Deliberately using a different email address to earn commission on your own orders is fraud, and we will close your account and withhold everything unpaid.

You can use your own codes. Using one of your follower codes or your personal code on an order of your own is fine. The order still earns no commission, as above.

Big discounts are for your audience. Follower codes are there to give your audience a reason to buy. If we reasonably suspect that a code with a high discount is being used mainly for your own orders or for your family or friends, rather than for your audience, we may do any of these:

  • cancel the orders involved, or not send them, and refund what was paid for them;
  • withhold the commission on those orders, or take it back from what we owe you now or in future if we have already paid it or you have swapped it for store credit;
  • take the discount those orders received back from what we owe you;
  • end the code;
  • end your place in the programme, as a serious breach under 18.3.

We will tell you what we have done and why. If you think we have got it wrong, reply and show us, and we will look at it again.

12.2 Traffic and tracking

Do not force clicks, load links invisibly, embed our pages in frames, use bots or automated traffic, or do anything else designed to attach your code to visits you did not genuinely generate.

12.3 Paid search and our brand

Do not bid on "Stimz", our product names, or misspellings and variations of them, in Google Ads or any other paid search, without our written permission. Do not register domains or accounts that could be mistaken for ours.

12.4 Messaging

Do not send unsolicited email, texts or direct messages promoting us. Do not use bought or scraped contact lists. If you email your own list, it must be a list that has properly consented to hear from you. We can be held responsible for spam sent on our behalf, so this one matters to us.

12.5 Coupon and deal sites

Do not post your codes or links to coupon sites, deal forums, cashback sites, voucher aggregators or browser extensions.

12.6 Content

Do not post anything about us that is illegal, hateful, discriminatory, defamatory, obscene, or that would sit badly next to a children's product. Do not use our products in a way that would be unsafe to copy.

12.7 Our customers' details

Anything you learn about our customers through the programme stays confidential and is not yours to use, keep, sell or market to.

13. Products we send you, and testing

We may send you products, either to use and talk about or to try and tell us what you think. If we do:

  • There is no obligation to post about them, but if you do post, section 9 applies in full and the post must be labelled "Ad".
  • We will tell you the normal retail price of what we send. That figure may matter for your tax (see section 14).
  • Products are sent for you, or your family, to use and talk about. Please do not resell them.

13.1 Testing, and why we want the bad news

Some of what we send is for testing, sometimes before it goes on sale. When we ask for feedback we mean it, and we want the unflattering kind: too loud, too rough, too small, fell apart, my child would not go near it, this is not for us. That is the feedback that changes a product before it ships, and it is worth more to us than praise.

So, plainly: nothing you earn, and nothing about your place in this programme, depends on your feedback being positive. We will never reduce someone's share, withhold product or drop them because they told us something we did not want to hear. If you ever feel otherwise, say so and we will look at why.

Testing feedback is private unless you say otherwise — it is for our product team, not for publishing. If we would like to quote you, we will ask first.

Anything we send for testing is still a product we sent you, so the tax point above applies to it in the same way.

13.2 If you have joined as a parent

Most of what we send to parents is really for their child to use. That is exactly how we want it to work: your child uses the product the way they normally would, and you tell us what happened. What they reached for, what they ignored, what helped, what annoyed them, what broke.

The feedback is yours, as the account holder. We are not asking your child to do anything for us: not to perform, present, review or appear anywhere. Nothing in this programme needs your child to be filmed or photographed, and a parent who only ever sends us written notes is doing exactly what we asked.

Whether your child appears in your own posts is a decision for you and your child, and section 2.2 sets out what comes with it.

14. Tax

You are responsible for your own tax. We deduct nothing for tax: the only thing that comes off a payment is Stripe's fee under 7.2.

  • Commission is taxable income, including if you also have a job, and including if you leave it sitting in your Stripe balance rather than withdrawing it.
  • Products and store credit we give you may also have tax implications, even where you receive no cash. That includes store credit you swap your commission for under 7.4, and the bonus on it. Whether they do, and at what value, depends on your circumstances. We tell you the normal retail price of what we send, and the amount of any store credit, so you have the figures if you need them.
  • HMRC has a trading allowance that may mean you have nothing to report, but it applies to your total income of this kind from all sources, not just from us, so we cannot tell you whether it covers you.
  • We can give you a statement of what we have paid you and the retail value of anything we have sent you. It is a record, not tax advice.
  • We may be required by HMRC to provide details of what we have paid you. For that reason we hold your name, address and payment records.

General information is at gov.uk/set-up-sole-trader and gov.uk/self-assessment-tax-returns. Nothing we say is tax advice. If you are unsure, speak to HMRC or an accountant.

15. Your content and our brand

15.1 Your content stays yours

You keep ownership of everything you make. By posting content that promotes us, you give us permission to reshare and repost it on our own social channels, our website and our emails, crediting you, for as long as you are in the programme and for 12 months afterwards. This permission comes as part of the arrangement and no separate fee is paid for it.

It does not cover paid advertising. We will never put your content into an advert we pay to run without asking you first, separately, for that specific use, and agreeing with you anything we pay for it. You are free to say no, and saying no changes nothing else about your place in the programme.

Posts with a child in them are different. We only repost a post in which someone under 18 appears if you have said yes for that specific post (see 2.2). If you withdraw that yes, we take it down from our website straight away and from our own channels as soon as we can.

If you would rather we did not use a particular post, tell us and we will take it down.

15.2 Our brand stays ours

Flexi Fidgets®, Stimz®, Spikz®, TextureClick® and Fidgeez® are our registered trade marks, and all our names and logos belong to us. We give you permission to use our name, logo and product images to promote us, in the way our brand guidelines describe. That permission can be withdrawn, and it ends when your place in the programme ends. At that point, please stop using our branding and take down or clearly de-link your promotional posts.

16. Your data

We hold information about you in order to run the programme, including information we collect about your public social media accounts. How we handle it, why, and what rights you have is set out in our Stimfluencer Privacy Notice, which forms part of these terms.

You and we are each independently responsible for our own compliance with data protection law. You are responsible for the personal data of your own audience. We are responsible for the data we hold about you and about our customers.

17. Confidentiality

Your rate, your levels, your figures and anything else we share with you that is not public stays between us. This continues after you leave the programme.

18. Pausing or ending your place

18.1 You can leave whenever you like

Email us and we will close your account. We will pay you any cleared balance in the normal way, and anything still clearing will be paid once it clears, provided the underlying orders stick.

18.2 We can end it too, at any time, for any reason

We can end your place at any time, with immediate effect, for any reason, and we do not have to give one. That includes deciding that you, your content or your channel are no longer the right fit for the Stimz brand, changing the direction of the programme, or making it smaller. We will tell you by email when we do. You keep all the commission you have properly earned up to that point, paid on the normal rules (see 18.4), unless 18.3 applies.

18.3 Fraud and serious breaches

We can suspend your place while we look into something, or end it, if you seriously or repeatedly breach these terms. That includes the labelling rules in section 9, the claims rules in section 10, the rules about children in section 11, and the prohibited conduct in section 12. Where the breach involves fraud or deliberate manipulation of tracking, or commission came from content that broke sections 9 to 12, we may withhold the unpaid commission connected to it. We will tell you what we have withheld and why. Commission that has nothing to do with the breach is still paid.

18.4 What happens afterwards

Orders placed before your place ended are paid on the normal rules. Orders placed after it do not count to you, whether they come through your link or your codes, and we switch off your follower codes.

Stop using our branding, and take down or de-link your promotional content. Sections 8, 13, 14, 16, 17, 20, 21 and 22 continue to apply.

19. Changes to these terms

We may update these terms. If a change materially affects you, we will email you at least 14 days before it takes effect. If you carry on in the programme after that, you have accepted the change. If you would rather not, you can leave under 18.1 and we will pay what you have earned.

Changes to rates, levels, the clearing period, the payment minimum and the payout fee follow the same notice period, except that a change Stripe makes to its own charges may be passed on from when it applies to us, and we will tell you as soon as we can. Rates and levels are covered by section 5.5 and the clearing period by section 7.1. The figures that apply to you at any time are the ones shown in your portal.

20. Our liability to you

We do not limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.

Subject to that:

  • We are not liable to you for loss of profit, loss of opportunity, or any indirect or consequential loss.
  • We do not promise the programme, the tracking, the portal or our website will be uninterrupted or error-free. If our tracking fails for reasons outside our control, including a customer's browser settings, we are not liable for commission that could not be attributed.
  • Our total liability to you in any 12 month period is limited to the total commission we paid you in the 12 months before the claim arose, or £500 if that is greater.

21. Your liability to us

If we suffer a loss, a fine, or a claim because of something you did or failed to do, in breach of these terms, you agree to cover it. This applies particularly to the advertising rules in sections 9 to 11, where a regulator can impose penalties on us for content posted by you.

This is not us looking for a reason to come after you. It is the counterpart of us carrying the legal responsibility for your posts, and it will only ever be used where the breach was serious and the loss was real.

22. General

  • Whole agreement. These terms, together with the privacy notice and our brand guidelines, are the whole agreement between us about the programme.
  • If part of it fails. If any part of these terms turns out to be unenforceable, the rest still stands.
  • Not enforcing something. If we do not enforce a term straight away, we have not given up the right to enforce it later.
  • Passing it on. You cannot transfer your place in the programme to anyone else. We can transfer this agreement to a company that takes over our business.
  • Third parties. Nobody other than you and us has any right to enforce these terms.
  • Notices. We will contact you at the email address on your account. Please contact us at stimfluencer@stimz.com.
  • Law. These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.
  • Problems. If something goes wrong, email us first. We would far rather sort it out directly.
